Authorization to Obtain Credit Report. By clicking the “Agree and Continue” button and continuing with the application process for a loan on Santia Financial’s website, www.santiafinancial.com, you understand and agree that you are authorizing Santia Financial and its Lending Partners, to each obtain a consumer credit report from one or more consumer credit reporting agencies and third-party data furnishers including, but not limited to TransUnion, Experian, Equifax. You expressly authorize Santia Financial and its Lending Partners and lenders in a Lending Partners lending network, if applicable, to obtain consumer reports from consumer reporting agencies about you periodically including for purposes of underwriting your loan application and throughout the term of your loan, including in the month following the month when you pay off or otherwise satisfy the loan.

We may use the credit report and information from third party data furnishers for any purpose authorized by applicable law in connection with a credit transaction involving you and involving the extension of credit to you or review or collection of your account, including but not limited to (i) for authentication purposes, to make sure you are who you say you are, (ii) to make credit decisions; (iii) to determine how much debt you currently have, in order to determine your debt-to-income ratio, and (iv) to obtain information and characteristics from your credit report from one or more consumer credit reporting agencies and third-party data furnishers. You authorize us to verify information in your credit report, and you agree that Santia Financial, its Lending Partners, and lenders in a Lending Partners lending network, if applicable, may contact third parties without further notice to you to verify any such information. We may obtain your credit report each time you apply for a loan with us and at any other time that we deem it necessary in our sole discretion.

 

E-Sign Consent

DISCLOSURE AND CONSENT TO ELECTRONIC RECEIPT OF LOAN DISCLOSURES AND ELECTRONIC CONTRACTING (“ESIGN ACT CONSENT”)

You understand that in order to submit a credit application to and engage in loans and related transactions with Santia Financial, its Affiliate as identified in Santia Financial’s Privacy Notice, its Lending Partners, lenders in a Lending Partner’s lending network,    and their service providers, (collectively referred to herein as “we”, “us”, or “our” unless otherwise indicated) and to view and retain a copy of the related notices, disclosures, agreements, authorizations, acknowledgements, terms and conditions, and other documents during the course of our relationship with you (collectively, “Disclosures”) you must consent to receive Disclosures and engage in transactions and enter into contracts and agreements electronically.

Described below are the terms and conditions for providing Disclosures to, and transacting business with you electronically. Please read the information below carefully and thoroughly.

You acknowledge and agree that we may provide you with the Disclosures in electronic format, and that we are not required to send a paper document to you, unless and until you withdraw your consent as described below. All Disclosures that we provide to you in electronic format will be provided either (i) via e-mail; or (ii) by access to our online platform.

 

  1. GETTING PAPER COPIES.

You may request from us a paper copy of any Disclosure that we have provided or made available to you electronically without charge, provided that such request is made within a reasonable time after we first provided the Disclosure to you. To request paper copies, of any Disclosure made by Santia Financial or on its website at www.santiafinancial.com, you must send an e-mail to support@santiafinancial.com with the subject line “Paper Loan Document Request” and in the body of the e-mail you must state your e-mail address, full name, US Postal address, and telephone number.  Please also specify (in the body of the email) which previously provided Disclosure you are requesting in paper copy. Alternatively, if you would like a paper copy of all loan origination documents (including origination Disclosures and borrower promissory note agreement) for loans made by Santia Financial, and their service providers, please request “All loan origination documents” in paper copy.  Requesting paper copies, as specified above, does not remove your previously provided consent to receive electronic Disclosures. To withdraw your consent to receive any future Disclosures in electronic format from Santia Financial and their service providers, please follow the instructions below under “Withdrawing your consent”.  To request paper copies, of any Disclosures, loan origination documents, or transaction documents made or provided directly to you by Affiliate or a lender in a Lending Partner’s lending network and their service providers, you must contact the Affiliate or lender in the Lending Partner’s lending network directly.

 

  1. WITHDRAWING YOUR CONSENT.

You may withdraw your consent to receive Disclosures electronically from Santia Financial, and their service providers by following the instructions below. If you have a pending loan request or application in process with us, or a loan that has been approved and is in the process of funding, withdrawing your consent will terminate your loan request or application and will result in the cancellation of any funds in the process of disbursement (except where prohibited by law).  After your loan has been originated and funded, you may withdraw your consent to receive any future Disclosures in electronic format. Withdrawing your consent does not apply to origination disclosures that were previously provided to you (electronically) prior to your loan funding (or at the time of funding). Withdrawing your consent may slow the speed at which we can deliver services to you.  You may withdraw your consent to receive future Disclosures electronically from Santia, and their service providers by sending an email to support@Santiafinancial.com with the subject line of “Withdraw electronic consent” and in the body of the email, state your full name, US Postal Address, email address, and telephone number.  You may withdraw your consent to receive future Disclosures electronically from Affiliate or a lender in a Lending Partner’s lending network by contacting the Affiliate or the lender in the Lending Partner’s lending network directly.

Your withdrawal of consent will be effective only after we have had a reasonable period of time to process your request.

 

  1. CHANGE IN YOUR EMAIL ADDRESS OR OTHER CONTACT INFORMATION.

To ensure you receive all Disclosures in a timely manner, you agree to promptly notify us of any change in your email address or home mailing address. To let Santia Financial, and their service providers know of a change in your e-mail address, within our borrower portal, go to “Account Settings”. You may also call our Customer Service team at (877) 770-1559.  You may change your email address or home mailing address with Affiliate or lenders in a Lending Partners lending network, by contacting the Affiliate or the lender in the Lending Partner’s lending network directly.

At our discretion, we may treat your failure to provide us with a valid e-mail address or the malfunction of a previously valid e-mail address as a withdrawal of your consent to receive electronic documents.

 

  1. REQUIRED HARDWARE AND SOFTWARE

In order to access and retain Disclosures electronically, you must satisfy the following computer hardware and software requirements: access to the Internet; an email account and related software capable of receiving email through the Internet; supported Web browsing software (Chrome version 32.0 or higher, Firefox version 26.0 or higher, Internet Explorer version 8.0 or higher, or Safari version 7.0 or higher); and hardware capable of running this software. To ensure access and optimal printing of your loan documents in PDF format, you must have Adobe Reader. To install the free version of Adobe Reader, click here.

Additional Mobile Technology Requirements.   If you are accessing our site and the Disclosures electronically via a mobile device (such as a smartphone, tablet, and the like), in addition to the above requirements, you must make sure that you have software on your mobile device that allows you to print and save the Disclosures presented to you during the application process. These applications can be found for most mobile devices in the device’s respective “app store.” If you do not have these capabilities on your mobile device, please access our site through a device that provides these capabilities.

Telephone Disclosure and Consent.   If you access our site and the Disclosures via a mobile device or provide us with a telephone number that is a mobile phone number, by accessing through or providing your mobile phone number, you consent to the receipt of information calls and text messages made by us or our service providers or any lender on your loan to provide services to you related to your loan request, application or loan, if approved and funded. You agree we may use automatic dialing systems and prerecorded calls to this number and any number you provide to us. Your mobile provider may charge message and data rates.

 

  1. FEDERAL LAW.

All Disclosures we provide to you in either electronic or paper format will be considered “in writing.” You should print or download a copy of this ESIGN Act Consent and any other Disclosures for your records. You agree, and we both intend the federal Electronic Signatures in Global and National Commerce Act to apply to (i) this ESIGN Act Consent and (ii) our ability to conduct business with you by electronic means.

 

  1. TERMINATION/CHANGE.

In our sole discretion, we reserve the right to provide you with any Disclosures in paper format and to discontinue the electronic provision of Disclosures at any time. We will provide you with notice of any such termination or change as required by law.

  1. ACKNOWLEDGING YOUR ACCESS AND CONSENT TO RECEIVE MATERIALS ELECTRONICALLY AND TO CONDUCT BUSINESS ELECTRONICALLY.

Lending Partner Matching Consent

I authorize Santia Financial and its Lending Partners to obtain my credit report and Social Security Number from a credit bureau to verify my identity and match me with lenders.  I further authorize Santia to provide to these Lending Partners my full Social Security Number and any information submitted to Santia. I further authorize these Lending Partners separately to obtain my consumer credit report, credit score, and other information from one or more consumer reporting agencies to verify my identity and provide me with quotes for credit products and services.

Privacy Notices

As your financial privacy is very important to us, this notice discusses Santia Financial and its subsidiaries and affiliates’ (“Santia”) privacy practices with respect to guarding the confidentiality and security of your personal information and the information you submit through this website.

What information does Santia collect through its website?

On our website, we collect personal information about you that you willingly provide us to generate consumer loan offers and other financial products and services. This information includes your name, address, email address, state of residence, phone number, amount of unsecured credit obligations, your IP address, your website interaction on the site and how you heard about us. Santia wishes to convey to its users that the only types of communications that are sent out are service-related emails that are in response to a user’s online inquiry requesting a consumer loan or other financial product or service. Users cannot opt-out from receiving these service-related emails while engaged in ongoing transactions with Santia. If your personally identifiable information changes, or if you no longer desire our service, you may contact us at the contact information provided at the end of this policy to correct, update, delete or deactivate your personal information.

We reserve the right to disclose your personally identifiable information as required to complete the requested transaction, service your account, as required by law or when we believe that disclosure is necessary to protect our rights and/or comply with a judicial proceeding, court order, or legal process served on our website.

We also may collect information that is not personally identifiable. Our website automatically collects clickstream information about your visit. This can include the address of the website from which you originated before visiting our website, the pages you visit on our website, and the browser you use.

If you apply for a loan or other financial product or service, we will collect additional personal information about you, including information about your education, home address, employment, financial and outstanding credit obligations, creditors, life events and financial condition.

How does Santia use the information it collects?

Santia does not share any information that it collects through its website with any other person or entity except as permitted by law and indicated in our privacy policy. The personal information we collect is initially used to evaluate your eligibility and underwrite you for a consumer loan. After evaluating your application, we will use the information you submitted to contact you about consumer loan and other financial products and services, explain how Santia can help relieve your credit burdens through a consumer loan, or suggest alternate options if Santia is unable to assist you.

We may share personal information about you to: (1) make a loan to you or broker a loan through third party lenders and lending networks, like our Lending Partners; or (2) service, collect, and maintain your account with us or the lenders or their assignees that make a loan to you. Thus, we may share personal information about you with your creditors, credit reporting agencies, and with other parties that help us to service and maintain your account. We may receive personal information about you from other parties such as credit reporting agencies, third parties who assist in identifying prospective consumers, data brokers, social media and marketing sources or your creditors.

Santia uses Google Analytics reporting to gather information on visitors to our website. We do not facilitate the merging of personally-identifiable information with non-personally-identifiable information previously collected from display advertising features that is based on the DoubleClick cookie unless we have robust notice of, and your prior affirmative (i.e. opt-in) consent to, that merger. We have implemented Google Analytics Demographics and Interest Reporting to gather information such as age, gender, and interests through our website. Santia uses this information to further enhance our visitors’ experiences on our website and to support display advertising. Using the Ads Settings, visitors can opt-out of Google Analytics for Display Advertising and customize Google Display Network ads.

As necessary, we may share non-personal information with our trusted third-party service providers, such as the corporations that manage or host our website, to perform services on our behalf. They typically use non-personal, anonymous information – like clickstream information regarding visit duration – that isn’t identifiable with a particular visitor to further improve the website.

The Pixels also allow us to provide information to third parties about how viewers engage with content or advertisements and how to reach the most interested audience.

Pixels collect IP address and location, date and time stamp, user agent, cookie IDs (if applicable), URL, time zone, and other browser-level data or cookie data.

Pixels for ad or content optimization is only used after such data has been aggregated with other data collected from advertisers or other third parties.

We may share aggregate statistics, metrics and other reports, such as the number of unique user views, demographics about the users who engaged in ads or content, conversion rates, and date and time information.

Does Santia have safeguards in place to protect my personal information?

We restrict access to your personal information only to those employees who need to know that information to service and maintain your account with us. We also maintain physical, electronic and procedural safeguards that comply with federal requirements to guard your personal information. All employees are trained on information security expectations to ensure the confidentiality and proper usage of data and the systems protecting the data.

Your California Privacy Rights

This section applies to any California residents about whom we have collected personal information from any source, including through your use of our Website(s), by entering into a loan transaction or acquiring other financial services and products through us, or by communicating with us electronically, in paper correspondence, or in person.

As a company regulated under the Gramm-Leach-Bliley Act (“GLBA”), Santia applies privacy and security protections to your personal information as required by US federal law. As such, certain of the personal information that we may process about you is exempted from the California Consumer Privacy Act (“CCPA”) and certain other personal information may be subject to the CCPA.

For purposes of this section, “personal information” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular California consumer/resident or household. Personal information does not include publicly available information or information that has been de-identified. In our descriptions, we have included all data collected without regard to exempt data under GLBA.

However, by doing so, we do not intend to waive claims of preemption under the GLBA and other similar regulations.

  • Indirectly from our clients or their agents. For example, through information we collect from our clients in the course of providing services to them.

  • From third-parties that interact with us in connection with the services we perform.   • To carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collections.
